Terms of Service

Introduction

Welcome to myOracle. These Terms of Service ("Terms") govern your access to and use of the myOracle mobile application and website (collectively, the "Service"), operated by Red Rift, Inc. ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Service.

Account Registration

When you create an account with us, you must provide accurate, complete, and current information. You are solely responsible for maintaining the confidentiality of your account and password, and for restricting access to your device.

You agree to accept responsibility for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.

We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

Eligibility

You must be at least 16 years old to use our Service. By using the Service, you represent and warrant that you are at least 16 years of age and have the legal capacity to enter into these Terms.

User Content

Our Service allows you to post, link, store, share, and otherwise make available certain information, text, graphics, or other material ("User Content"). You retain all rights in, and are solely responsible for, the User Content you post to the Service.

By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in any and all media or distribution methods now known or later developed, including for commercial purposes such as marketing and advertising.

Training Rights: You specifically acknowledge and agree that we may use your User Content, including all interactions with our spiritual guides, to train, develop, and improve our artificial intelligence models, algorithms, and future service offerings. This grant of rights is irrevocable and perpetual.

You represent and warrant that:

  • You own or have the necessary rights to the User Content you post;
  • The User Content does not violate the rights of any third party, including intellectual property rights and privacy rights;
  • The User Content complies with these Terms and applicable law.

Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation;
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity;
  • Engage in any harassing, abusive, or harmful conduct toward other users;
  • Send spam or any other form of unsolicited communication;
  • Attempt to access areas or features of the Service that you are not authorized to access;
  • Upload or transmit viruses, malware, or other types of malicious software;
  • Interfere with or disrupt the Service or servers or networks connected to the Service;
  • Collect or harvest any information from the Service, including user profiles or content, without permission;
  • Use the Service for any illegal or unauthorized purpose.

Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Red Rift, Inc. and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Red Rift, Inc.

Purchases and Payments

The Service includes the ability to purchase digital currency ("Gems") and subscriptions. All purchases are final and non-refundable, except as required by applicable law.

By making a purchase, you represent and warrant that:

  • The payment information you provide is accurate and complete;
  • You are authorized to use the payment method provided;
  • You will pay the charges incurred at the prices in effect when the charges are incurred.

We reserve the right to change our prices at any time. Any price changes will be communicated through the Service.

In-app purchases and subscriptions are managed by your device's app store (e.g., Apple App Store, Google Play Store) and are subject to their terms and conditions.

Refund Policy

This Refund Policy applies to all purchases made through the myOracle application and website.

No-Refund Policy

All purchases are final and non-refundable. This includes, but is not limited to:

  • Gems (digital currency) purchases;
  • Subscription payments;
  • Premium divination readings;
  • Special features and content;
  • Any other digital goods or services offered through the Service.

Exceptions to the No-Refund Policy

We do not provide refunds for any reason except in the following extremely limited circumstances:

  • Where explicitly required by applicable law that cannot be waived by these Terms;
  • In the event of a demonstrable, significant technical error that completely prevents delivery of the purchased service (not merely dissatisfaction with the content or quality);
  • Unauthorized charges where you can provide evidence that you did not authorize the purchase (subject to investigation).

Important Statements

For the avoidance of doubt, we do not provide refunds in the following circumstances:

  • You are dissatisfied with the quality or content of divination readings or spiritual guidance;
  • You changed your mind about a purchase;
  • You claim you purchased by mistake or did not intend to make the purchase;
  • You do not have time to use the purchased features or services;
  • You believe the divination readings or predictions were not accurate;
  • Technical issues on your device prevented optimal experience.

Procedure for Exceptional Refund Requests

In the rare event that you believe you qualify for an exception to our No-Refund Policy, you must:

  • Contact us at [email protected] within 48 hours of the purchase;
  • Provide your account details, transaction ID, and comprehensive evidence supporting your claim;
  • Allow up to 30 days for investigation and processing.

All refund determinations are made at our sole discretion. By using our Service and making purchases, you acknowledge and agree to these strict refund terms.

Chat Rules and Guidelines

Your conversations with our spiritual guides, tarot readers, astrologers, and other mystical advisors (collectively, the "Spiritual Guides") in the chat section of myOracle (the "Chat") are monitored and moderated by us and are subject to these Chat Rules.

Chat Conduct Requirements

During conversations with Spiritual Guides, you shall abide by the following rules:

  • Ask clear, specific questions about your concerns and areas of interest. Questions should be presented sequentially and should not be deliberately vague or ambiguous.
  • Do not abruptly end sessions without allowing the Spiritual Guide to provide a response.
  • Maintain respectful communication at all times. Obscene, offensive, or indecent language is strictly prohibited.
  • Do not insult, harass, humiliate, or threaten the Spiritual Guides under any circumstances.
  • Do not question or criticize the professional qualities or abilities of the Spiritual Guides. Our Spiritual Guides have been carefully selected based on their knowledge, skills, and abilities to provide insightful guidance.
  • Do not attempt to extract personal information from Spiritual Guides or share your own sensitive personal information (such as full name, address, financial details).

Violation Consequences

Each violation of these Chat Rules will result in a formal warning from our moderation team. After receiving two warnings, any subsequent violation may result in immediate termination of your access to the Chat feature, with notification of such termination.

We reserve the right to terminate your access to Chat features without prior warning for severe violations of these Rules or our Terms and Conditions of Use, including but not limited to threatening behavior, hate speech, or attempts to use the Service for unlawful purposes.

You may appeal the termination of your Chat access by contacting us at [email protected], though reinstatement is at our sole discretion.

Gem Penalties and Account Restoration

In addition to or as an alternative to warnings and termination, we may, at our sole discretion, impose Gem penalties for violations of these Chat Rules or other Terms. These penalties may include:

  • Deduction of Gems from your account balance for minor violations;
  • Requirement to pay a specified amount of Gems to lift temporary chat restrictions;
  • Requirement to pay a specified amount of Gems to unblock your account after a violation-related suspension.

The specific number of Gems required to restore account access or lift restrictions will be determined by us based on the severity and frequency of violations, and will be communicated to you at the time of penalty imposition.

If you lack sufficient Gems to pay a penalty, you will need to purchase additional Gems through the Service. Payment of Gem penalties does not exempt you from complying with these Rules in the future, and repeated violations may result in permanent account termination that cannot be reversed through Gem payments.

We reserve the right to refuse account restoration even after Gem payment if we determine, in our sole discretion, that allowing your continued access would negatively impact our community or Service.

Information provided through the Chat is for entertainment and informational purposes only. Our Service is not intended to substitute for professional advice of any kind, including but not limited to:

Entertainment Purposes Only: All divination readings, horoscopes, prophecies, and spiritual guidance provided through the Service are for entertainment purposes only. While we strive to provide meaningful and personalized experiences, the Service is not intended to provide medical, legal, financial, or professional advice.

No Guarantees: We make no guarantees regarding the accuracy, reliability, or completeness of any divination readings or spiritual guidance provided through the Service. You acknowledge that results may vary and that you use such information at your own risk.

AI-Generated Content: Many of our spiritual guides and readings are powered by artificial intelligence. You acknowledge that these are generated using algorithms and may not reflect actual spiritual or mystical practices as performed by human practitioners.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RED RIFT, INC., ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.

IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE LAST SIX (6) MONTHS, OR, IF GREATER, ONE HUNDRED DOLLARS ($100).

Indemnification

You agree to defend, indemnify, and hold harmless Red Rift, Inc., its affiliates, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney fees and costs, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions. Any legal action or proceeding relating to your access to, or use of, the Service shall be instituted exclusively in the federal or state courts located in Oakland County, Michigan.

If you are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident.

EU Specific Terms

If you are a European Union consumer, you have the right to withdraw from a purchase within 14 days without giving any reason, as provided by EU consumer protection law. However, this right of withdrawal does not apply to digital content (such as Gems or digital readings) if the delivery has begun with your prior express consent and acknowledgment that you thereby lose your right of withdrawal.

For EU consumers, alternative dispute resolution is available through the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by updating the "Last Updated" date at the top of these Terms and/or by providing other notice as required by applicable law. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes.

Electronic Communications

By using the Service, you consent to receiving electronic communications from us. These may include notices about your account, promotional messages, and information concerning or related to the Service. You agree that any notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing.

Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

Entire Agreement

These Terms constitute the entire agreement between you and Red Rift, Inc. regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.
